As we already know, the H1-B visa application for the 2018-19 season has just begun. The screening process is going to be very tough this year.
But, the excitement around H-1B visa is losing its shine due to the strict examination or investigation for H-1B approvals.
The consulate offices all over the world are expected to follow set of new guidelines USCIS has sent out for the H-1B approvals/screening.

India is the largest applicant and recipient of the visa after China. India and China put together to contribute to more than 80% of total 65,000 H-1B petitions that are filed every year. The immigration attorneys are expecting the highest level of visa rejections this year according to the US immigration attorneys.
“We hear things are going to be extremely tough for H-1B applications. Earlier, screening processes were a bit relaxed as the US also wanted more foreign workers with specialized skills. Now with Trump administration pushing the immigration issue to mainstream discussion every now and then, overall there is a hostile body language against Indian or foreign workers in the US. But most business houses are still in favor of immigrant tech workers as they made business sense to them.”, said by Andrew Green, the US-based immigration lawyer.
Foreign companies working with the US-based clients need to prove the specific need of a candidate that they are sponsoring H-1B visa for.
As per Hansa Iyengar, senior analyst, advanced digital services, at London-based Ovum Technology Research, Indian IT firms need to make sure that they are actually bringing in the required talent to address the complex technologies. Foreign companies working with the US-based clients need to prove the specific need of a candidate that they are sponsoring H-1B visa for. USCIS has issued strict rules to make sure that these companies are not abusing the provision for H-1B visa.
“The era of low-cost H1B resources has hit crossroads with there being a lot of negative sentiment around job displacements and the need to prevent an influx of low-cost labor. But there are two sides to a coin and the immigrant workforce plays a critical role in filling in gaps in the tech workforce, and this is being ignored in all the rhetoric.”, added by Green.
Most of the anti-outsourcing campaigns by the Trump administration claim that, they have been designed to increase the local employment in the US. Most of these companies are aware that the need for tech resources will continue to remain high as there aren’t enough skilled Americans to fill all vacant positions.
“Also, many factors need to click for filling positions in areas such as AI, data science and other upcoming technology spaces and not all skills can be found locally. Moreover, with unemployment rates at historically low levels in the US, there is a dearth of candidates in the work-pool and any lateral hiring will only serve to drive up wages,’’ argued by Hansa Iyengar.
Recently, the progressives for Immigration, Reforms, a Washington-based anti -immigrant outfit, has put up anti-H-1B advertisements, paying $80,000, at railway stations and on trains around San Francisco Bay Area and San Jose in California, which is the hub of the world’s top IT firms including Google, Apple, IBM, Intel, Cisco, FB and Twitter. A large number of of H-1B visas are issued to Indians who work in tech firms in this region.
